1. Statutory rights in the event of defects
In the event of defects, consumers have statutory rights against the respective seller pursuant to Sections 437 et seq. of the German Civil Code (BGB). Subject to the statutory requirements, these include, in particular, subsequent performance, withdrawal from the contract or a price reduction, and, where applicable, damages. Exercising these statutory rights is free of charge.
These statutory rights are neither restricted nor replaced by the following voluntary manufacturer's warranty. The manufacturer's warranty exists in addition to and independently of the statutory rights in the event of defects.
If a defective condition of the goods becomes apparent within one year of the transfer of risk, the statutory presumption under Section 477 of the German Civil Code (BGB) applies: it is presumed that the goods were already defective at the time the risk passed, unless this presumption is incompatible with the nature of the goods or the defective condition. For goods with digital elements, the statutory special provisions also apply.
Note on the reversal of the burden of proof:
If a defect occurs within twelve months after delivery of the goods, it is legally presumed that the defect already existed at the time of delivery, unless the seller proves otherwise (Section 477 of the German Civil Code (BGB)).

Warranty inquiries and claims should primarily be submitted through the respective contractual retailer or seller from whom the product was purchased. Direct claims against the warrantor at support@thermaltake.de are possible in the cases described in Section 6.
3. Covered products, type of warranty, and geographic scope
In addition to the statutory rights in the event of defects, the warrantor provides a voluntary limited manufacturer's warranty within the meaning of Section 443 of the German Civil Code (BGB) in accordance with the following provisions.
The warranty applies to new Thermaltake products purchased by a consumer within the European Union from Thermaltake or an authorized retailer, for which a limited manufacturer's warranty was specified at the time of purchase.
This warranty is exclusively a voluntary limited manufacturer's warranty for material and manufacturing defects when used as intended. Depending on the warranty period applicable to the respective model, it is referred to, for example, as a “3-year limited manufacturer's warranty,” “5-year limited manufacturer's warranty,” “7-year limited manufacturer's warranty,” or “10-year limited manufacturer's warranty.”
Specifying the warranty period does not constitute a guarantee of any specific technical service life or useful life of the product, nor of continuously consistent functionality or performance. In particular, the warranty does not constitute an express commercial durability guarantee under which the entire product must retain all required functions and performance throughout the stated warranty period under normal use. Therefore, no harmonized EU-GARAN label is used for this limited manufacturer's warranty.
The product specifically covered is determined by its product name and model number. The duration of the limited manufacturer's warranty applicable to the respective model is stated in the Thermaltake Warranty Overview. The warranty period specified for the specific model at the time of purchase is decisive. This warranty period must be provided to the consumer together with this warranty statement on a durable medium no later than upon delivery.
Other content or international warranty terms on the website mentioned do not form part of this warranty statement. For consumers within the scope of this statement, only these warranty terms apply.
Limited Manufacturer's Warranty Terms
In addition to the statutory warranty, Thermaltake voluntarily grants a limited manufacturer's warranty of [z. B. 1 bis 10 Jahren] for certain products. This warranty is valid from the purchase date and covers material and manufacturing defects under normal use.

The warranty is valid from the purchase date and only upon presentation of proof of purchase. Proof of purchase is required to make a warranty claim. Please contact our Customer Service before returning a product.
4. Start and Duration of the Warranty
The warranty begins on the purchase date stated on the proof of purchase. If no proof of purchase is available, the purchase date may be substantiated by another suitable form of evidence. If this is also not possible, the warrantor may determine the start date based on the product and delivery data available to it.
Repair or replacement does not restart or extend the original guarantee period. Statutory rights and statutory circumstances resulting in suspension or restart remain unaffected.
5. Content of the Limited Manufacturer's Guarantee
The guarantee covers material and manufacturing defects that occur during the applicable guarantee period when the product is used as intended. It does not constitute a promise of a specific technical service life or a guarantee that the product will retain all functions or a specific level of performance, regardless of material or manufacturing defects, for a specific period.
If a guarantee case exists, the guarantor will, at its discretion, provide one of the following services:
free repair of the affected product or
Replacement with a defect-free product that is at least technically equivalent.
If neither repair nor replacement is possible or economically reasonable, the guarantor may offer another appropriate solution. Such a solution requires the consumer's consent; their statutory rights against the seller remain unaffected.
The guarantee covers the spare parts, labor, and standard shipping costs within the European Union that are necessary for an approved guarantee service and have been agreed in advance. Express, special, customs, or other additional costs will only be covered if the guarantor has approved them in advance.
6. Handling and Assertion of the Guarantee
For the manufacturer's guarantee to be handled as a priority, the consumer should first contact the respective contractual dealer or seller from whom the product was purchased. If the seller offers to handle manufacturer's guarantees, it will accept the required documents and coordinate further processing with the guarantor.
The guarantee may be asserted directly against the guarantor at support@thermaltake.de if the seller does not offer or refuses to handle the manufacturer's guarantee, no longer exists or cannot be reached, does not process the claim within a reasonable period, or prior processing through the seller would be unreasonable for the consumer in the individual case. In other cases, the guarantor may initially refer the consumer to the seller. The consumer's statutory rights regarding defects against the seller remain unaffected.
The following information and documents should be submitted to ensure prompt assessment:
- name and contact details of the claimant;
- product name, model number, and serial number;
- suitable proof of the purchase date;
- a clear description of the defect and the circumstances in which it occurred;
- photos or other documentation, insofar as reasonable and helpful for diagnosing the defect.
The warrantor may request further information insofar as this is necessary to assess the warranty claim and is reasonable for the consumer. Submission of the original invoice is not required if the purchase date and the registered product can be proven in another suitable manner.
Products may be sent in only after consultation and in accordance with the shipping instructions provided. Products sent in without prior request may delay processing. This does not restrict the consumer's statutory rights.
If the inspection shows that there is no warranty case, diagnostic, repair, or return shipping costs will be charged only if the consumer was informed in advance of the expected costs and agreed to the chargeable service.
7. Exclusions
There is no warranty claim insofar as the damage or defect being claimed was caused by:
- use not in accordance with the intended purpose or contrary to the operating instructions;
- accident, external force, fire, flooding, lightning strike, overvoltage, corrosion, or comparable external influences;
- unauthorized modifications, improper installation, or repair attempts not carried out professionally;
- use of unsuitable components, connectors, cables, operating materials, or power supplies;
- normal wear and tear customary for the product, unless caused by a material or manufacturing defect;
- intentional damage or improper use.
A modification or repair does not, by itself, result in the loss of the warranty. The exclusion applies only insofar as there is a causal connection between the respective circumstance and the defect being claimed.
For products whose serial number or identification marking has been removed, made illegible, or tampered with, warranty service may be refused only if this makes it impossible to clearly identify the product or verify warranty eligibility. Counterfeit products are not covered by the warranty.
8. Data and submitted components
Before sending in the product, the consumer must make a current backup of their data, remove personal data where possible, and temporarily disable any required access credentials or encryption for inspection. Data, software, and settings may be deleted during a repair or replacement.
The statutory liability provisions apply to data loss and other damage. Accessories not required for troubleshooting should be sent in only upon explicit request.
9. Disclaimer and statutory liability
The voluntary manufacturer's warranty exclusively establishes the claims for repair, replacement, or another reasonable solution agreed in the individual case, as expressly described in this warranty statement. No further claims arise solely from this voluntary manufacturer's warranty.
Thermaltake products are not intended for use in life-support systems, medical devices, or military equipment unless the specific product has been expressly approved and appropriately certified for such use.
To the extent permitted by law, the warrantor shall not be liable under this voluntary manufacturer's warranty for indirect damage, consequential damage, loss of profit, or loss of business opportunities. This exclusion shall not apply where liability exists under mandatory statutory provisions.
The statutory liability provisions remain fully applicable. This applies in particular to liability for intent and gross negligence, injury to life, body or health, under the Product Liability Act, and pursuant to other mandatory statutory provisions.
10. Final provisions
German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence shall remain unaffected.
If any provision of this warranty statement is or becomes wholly or partially invalid, the remaining provisions shall remain effective to the extent permitted by law.
This warranty statement must be provided to the consumer in accordance with Section 479 (2) of the German Civil Code, together with the warranty period applicable to their specific product, on a durable medium no later than upon delivery.
